Nightmare Tenants Have Endured at Chris King Avery Owned Property in Albany, NY

**UPDATE (10-04): After multiple citations having been issued by police the offending tenants have recently moved. note: I do not want to go into he said she said and have avoided that. So suffice it to say the events and videos taken here were from a prolonged period of time. Upload dates or when files are named are inconsequential. Extraordinary measures were taken to time and date stamp the videos using a reliable, unbiased and live external source. This was rather painstaking and sometimes actually prevented some incidents from being videoed. But again, how many videos do you see that have gone to this extent to verify? It doesn’t take a sleuth to also look at the surroundings to see certain things show an elapse of time and days/weeks/months. Even things like the filth with garbage as in the above photo were far from isolated incidents. There are plenty of videos/photos that show how long some of these things were left like this as well as different incidences/variations of unsanitary messes. There were also a number of efforts/suggestions to get some of these things mentioned in this article addressed in a simple, reasonable manner that could have at least diminished the problem and prevented things from getting to the point they did. It is also worth mentioning that there is not a time of day that it is legal or not a breach of quiet enjoyment when people are needlessly subjected to excessive noise and menacing… Unsanitary conditions also don’t have an acceptable time of day… Just wanted to be clear on some things that I think should have already been clear.

I will also simply mention that any complaints that the events here are untrue or that there is any kind of defamation of character need only look at the facts. Calling those with the facts liars would, however, possibly be defamation of character… Want to stress that great pains were taken to document what is in this story. There is more documentation and video than the vast majority of stories you will ever find. It is above and beyond what should be needed to show any objective person what a bad situation it has been. It has also been noted that there is even more, including text messages, but I think at this point any reasonable person would be satisfied that this was not dealt with properly, according to tenant/landlord law. I would also note that text messages can be and routinely are used in court. The courts can also subpoena old text messages and such at the source if they feel they would be pertinent. This is only mentioned to be informative. The hope is that some responsibilities have become clearer and will not repeat.

**UPDATE (08-16): They were cited by police for the noise this past week (now up to 3 times – 8/20). Other more disturbing video from a couple weeks ago of an interaction involving someone with one of landlord’s tenants further highlighting major safety concerns is also available. The case continues to grow.

There is a lot to this story so it will take some time to complete. But there is a ton of evidence of how a landlord named Chris King Avery has refused to confront a terrible ordeal at his apartment complex on Broad Street in Albany, NY. It involves serious safety and health issues. And it totally destroys the legal doctrine called the “implied warranty of habitability.”

You hear the word slumlord tossed around a lot about landlords who don’t like to deal with repairs and such at properties. We will let others decide what to call this. But I have heard of few places that rise to this level. But the evidence is overwhelming that a terrible prolonged injustice has occurred that nobody should have to endure. It should not even matter that there are people with disabilities having to go through this. Nobody should have to be subjected to this.

The tenants were told by the landlord, Chris King Avery that they could be given notice to leave for complaining about issues at the apartment a long time ago. This kept the tenants afraid to speak out about what was going on. At a certain point the issues became unbearable. But the landlord and his agent made it clear that he was not interested in dealing with the issues. It was even stated via text message that it wasn’t his problem and he didn’t have to do anything. He certainly kept to that statement. Chris Avery knows the tenants are not in a position to move so that fact left them at his mercy. He has said on several occasions that they should be reported to the police. It seems doubtful given everything else that he took credit for any calls.

Just a quick overview and then on to the facts of what has gone on. This ranges from drugs being done out in the open, pit bull dogs being allowed to run loose and also block the neighbors entrance/exit, threats being made, a consistent bombardment of music and noise at all hours, mice infestation that was never alleviated despite desperate attempts.  Daily attempts to aggravate people, including personal information being yelled out that was credited by the tenants in question with being given to them by the landlord. These are the people he is willing to lay it all on the line for so would he call them liars? It is just childish pathetic stuff by unbelievably hypocritical people who seem to have no lives and nothing to do other than trying irritate people. It is very creepy stuff when people like this seem to just want to stare at you or harass you at your only entrance/exit.

Too bad Mr. Avery didn’t enforce habitability issues or, if giving any personal information to the other tenants he has been protecting, maybe had mentioned that people with asthma are being affected by the smoke on their doorstep or that someone also has Multiple Sclerosis. Not that they don’t already know. If that doesn’t tell you all you need to know about people. Its telling of how low things can go when you have people like this, including a landlord whose job is to provide at minimum a safe, healthy environment won’t even let that influence their terrible decisions. Then there are other health related issues like dogs using the porch as a toilet and not cleaning it up for months and months. It wasn’t until the tenants had given the landlord an ultimatum on calling code enforcement that this started to become less of a problem. But the horrible smells that smell like dog crap and who knows what continued to billow out of the neighbors apartment.

Chris King Avery works at the King of Credit in Clifton Park. It is an auto dealer. After looking at the evidence here and how he does business as a landlord would you want to buy a car from him? Can you imagine dealing this way as a used car salesman? I will include some videos in with the text as I get more of this story out. There is a lot to tell. Christopher Avery is also on record for renting without the proper licensing.

**Update 07-12-18** Text message to Avery’s agent, Al Manwaring last weekend about an escalation of issues here went unanswered. This is a maintenance person from Manwaring Maintenance of which Avery has been through several in the few years the tenants have been at the Albany location. All the tenants have been able to get from the landlord over the past month are emoticon replies and a complaint that he was trying to enjoy a vacation. Can you imagine after the daily barrages they have dealt with? At times he claims Manwaring is the person to contact and recently that has been stated by the maintenance person as well. But it hasn’t been consistent and never official. The maintenance person has been unable to get the bored neighbors from hell to find something to do with their lives. Has he tried? Your guess is as good as anyone’s. But many people would refuse to work for someone who allowed this to go on. I wonder if Mr. Manwaring knows that a representative for a landlord can be held accountable along with the landlord in Albany regarding code issues. I have a redacted copy of such a case in Albany from just this year. It makes one wonder if the reasoning would be applicable in other venues/courts. Mr. Manwaring has not followed up on what appear to be code issues from over a month ago.

Also says he is a Civil servant of Schenectady County per Facebook. I wonder how he does his performed duties as a landlord represents Schenectady County? His patriotic themed posts and posts about criminals being busted does not seem to jive whatsoever with his allowing what is going on at this residence. Does it seem he represents Albany, Rensselaer, Schenectady or any other area with patriotism or decency? The evidence speaks for itself and it continues to go on. *Updated 07-30-18*
